Partner Andrew Gilmore has provided comment in City AM on the ECHR’s decision this week in relation to Sir Phillip Green’s challenge of UK parliamentary privilege, as the Court unanimously found that the UK had not violated the European Convention on Human Rights.

Commenting on the ECHR’s decision, Andrew said: “This ruling by the ECHR reaffirms the long-held principle that the UK has no obligation at all to stop parliamentary privilege being used to circumvent a court order, and that it is up to member states to manage their own legal frameworks in this regard.

“The right for MPs to express themselves freely in parliament has been a cornerstone of the UK constitution since the Bill of Rights in 1689 and this ruling reinforces parliament’s sovereignty.”
