Henna Elahi comments on the legal implications of the AWS outage, in BBC News and The London Standard
21 Oct, 2025 - HENNA ELAHISenior Associate Henna Elahi has provided comment in BBC News, The London Standard and across the trade press on the potential legal implications of the AWS outage, outlining the next steps both businesses and consumers may seek to take.
Commenting on the legal issues raised following the outage, Henna noted: “An outage such as this can certainly open the provider and its users to risk of loss, especially businesses that rely on its infrastructure to operate critical services. The extent of the legal implications following this outage depends on several factors, such as the terms of service and any service level agreements between the business and AWS, the specific causes and circumstances of the outage and its severity and length.”
She went on to discuss the specific impacts for the banks affected, which notably included Halifax, Lloyds Bank and Bank of Scotland, commenting: “The impacts on Lloyds Bank, for example, could have very serious implications for the end user. Key payments and transfers that are being made may fail and this could lead to far reaching issues for a user such as causing breaches of contracts, failure to complete purchases and failure to provide security information. This may very well lead to customer complaints and attempts to recover any loss caused by the outage from the business.”
Henna’s comments were published in BBC News, The London Standard, Tech Radar and The Register, 20 October 2025.
