Managing Partner Daniel Astaire has provided comment in City AM on US President Donald Trump’s $10 billion lawsuit against the BBC, which was filed in Florida this week.

Commenting on the potential outcome of the case, and the key aspects it hinges on, Daniel noted: “The sum claimed by Mr Trump certainly appears to be exaggerated, and it is extremely unlikely that a court would award him anything close to $10 billion.

“Trump must show that the video caused ‘serious harm’ to his reputation and then quantify this damage. The key factor is whether the reasonable viewer would believe the video to be true and not realise it has been falsified – the meaning of the statement, as conveyed by the video, will be crucial in determining whether it is defamatory.”
